§1. General provisions

  1. BONATED Company Ltd. o.o. sells goods for via the Internet with using the product page.

  2. Orders in The store can be used by individuals who are at least 18 years old years, minors for consent of legal guardians, legal persons and organizational units without legal personality to which the law grants legal capacity.

  3. All products offered in in the store are brand new.

  4. The prices presented are expressed in Polish zlotys and include VAT. Prices do not include shipping costs. Shipping costs are added as a separate item in basket. Information about the shipping price is provided before the conclusion of the sales contract.

  5. The price given for each product is binding from the moment the order is sent to implementation. The price is binding on both the Client and Seller: BONATED Ltd. o.o. BONATED Company Ltd. o.o. reserves the right to: change the prices of goods in offer, with excluding situations where mentioned in paragraph 5, introducing new goods to offer, conduct and cancelling promotional and sale campaigns store pages or entering them changes.

§2. Placing orders and payments

       7. In case of payment by card, the order processing time is counted from the moment of positive transaction authorization.

  1. If after after placing an order, it turns out that the ordered product is currently unavailable, the Buyer will be informed immediately informed by e-mail or telephone.

  2. If such a situation occurs, the Buyer decides to its implementation (extending the waiting time or canceling the order).

  3. If the Buyer makes a decision (when the Store is not in able to complete the entire order) part of the order, the remaining amount (in case of prepayment) will be paid to him turned to indicated account.

  4. If the Buyer decides to resignation from orders (if the store is not in able to complete the entire order) the entire amount will be refunded to the Buyer (in case of prepayment) the account indicated by him.

  7. If on there is incorrect data on the fiscal receipt or VAT invoice, according to By regulation of the Minister of Finance, the buyer must issue a correction note. Complete changes to the buyer's details are not possible.

  8. When placing an order, the Buyer may select the so-called recurring product shipping option ("Subscription").Subscription consists of placing an order with frequency of one, two, or three monthly payments and shipments of products that are renewed from frequency chosen by the buyer – without the need to place new orders.

  9. By choosing a Subscription, the buyer agrees to cyclical collection of payments by the operator from the buyer's payment card the price of products subject to Subscription, increased by Delivery costs. Detailed payment methods are provided in payment operator regulations.

  10. The remaining provisions of these Regulations apply to Subscriptions.

§3. Cost and delivery time

  1. The store delivers parcels to Buyer for via Polish Post and courier company.

  2. Delivery of the parcel to The customer is subject to payment, unless the contract states otherwise. Product delivery costs are transparent and are included in "Shipping costs" tab and in when placing an order.

  3. The store does not allow personal collection of orders.

  4. Shipments are delivered to in Poland and other European Union countries (additional fee for international shipments).

  5. The buyer is obliged to receipt of the ordered goods and settlement of debts for ordered goods in accordance with chosen payment method.

  6. The goods ordered by the Buyer will be delivered to the address indicated by the Buyer when placing the order or to parcel locker indicated by the Buyer.
    IN If the Buyer fails to collect the parcel, it is obliged to cover the costs of returning the parcel to Seller, i.e. return shipping costs.

  7. If the Buyer fails to collect the parcel, the Seller will call him/her to perform the contract, i.e. to cover additional costs incurred by the Seller, i.e. return shipping costs Seller and re-shipping costs. After ineffective expiry of the deadline set by the Seller, he will withdraw from the contract from the contract and will refund the Buyer the cost of the products reduced by return shipping costs for unclaimed products.

    3. the protocol should include information on about the status of the shipment;

    4. damaged products, type of damage and possible deficiencies in order;

    5. the report should be legibly signed by the courier.

§4. Withdrawal from sales contract concluded on distance

  1. The store guarantees the refund of an amount equal to the price of the goods in within 10 working days using the same payment methods as those used by the Buyer in primary transaction, unless the Buyer agrees to another solution.
  2. The store informs that in in case of withdrawal from contract, the Buyer is obliged to bear the costs of returning the goods to store. §5. Seller's liability for non-conformity of the goods with contract. Complaints. 

  1. The seller is obliged to deliver goods in accordance with agreement.
  2. The Seller is liable to the Buyer if the goods sold are inconsistent with contract (warranty). In in such a case the Buyer may submit to seller a complaint.

With the note: COMPLAINT.

  1. In order to file a complaint, the Buyer may use complaint form prepared by the Store. Using form is not mandatory.
  2. In the complaint, the Buyer should indicate the reason for the complaint and the content of their request. The complaint should also include the Buyer's data, enabling a response to the complaint. complaint (name and name, address).
  3. The buyer submitting a complaint regarding the goods should present proof of purchase (e.g. fiscal receipt - paper or electronic), VAT invoice (paper or electronic), e-mail confirmation of placing the online order, confirmation of the transfer from card/account. No proof of purchase indicating that the Seller is the entity responsible for warranty, may result in rejection of the complaint.
  4. Seller in within 14 days from on the day of receiving the complaint, the Company will respond to her.

  5. The cost of the returned goods is refunded by the Store after receiving the shipment and If the complaint is accepted, the damaged product will be replaced full-fledged.   4. The Buyer's personal data will not be transferred to third country/international organization;
  5. The Buyer's personal data will be stored for the duration of the contract, and after its execution or withdrawal of consent only in in the scope of the need to pursue possible claims in court or if national, EU or international law obliges us to data retention. The administrator has the right to make the Buyer's personal data available to entities authorized pursuant to applicable law (e.g. law enforcement authorities);
  6. The buyer has the right to access the content of your data and the right to rectify, delete, limit processing, the right to data portability, right to object, right to withdrawal of consent in at any time without affecting compliance with processing law;

§7. Final provisions

  2. The parties will try to resolve all disputes amicably, and If such an agreement is not possible, the dispute will be resolved by the competent common court.
  3. Placing an order constitutes acceptance of the provisions of these regulations.

  5. In matters not regulated in the regulations apply the provisions of the Act on provision of services by electronic means, the Act on consumer rights, the Act on personal data protection, the Act on copyright and related rights, the Civil Code and other mandatory provisions of Polish law.
  6. Taking care of Consumer rights is one of the priorities of the Company's activities, therefore the provisions of these Regulations do not apply in order to exclude or limit any rights of Consumers to which they are entitled pursuant to the mandatory provisions of the Law, and any possible doubts should be explained Consumer benefit. §8.Extrajudicial methods of dealing with complaints and pursuing claims

- The customer can get free help in regarding the resolution of the dispute between the Client and Shop, also using free assistance from the district (municipal) consumer ombudsman or social organization, whose statutory tasks include consumer protection,

  1. Detailed information on the possibility for the Customer to use out-of-court complaint resolution methods and claims and access rules these procedures are available in headquarters and on websites of district (municipal) consumer ombudsmen, social organizations, whose statutory tasks include consumer protection, the Provincial Inspectorates of the Trade Inspection and website of the Office of Competition and Consumer Protection Consumers (http://www.uokik.gov.pl).
